Référence à la tradition du systTHE rACTS (Extract) (francais : voir p. 226) The facts of the case as submitted -by the three applicants may b e summarised as follows : The first applicant is the Liberal Party of the United Kingdom an d Northern Ireland ('The Liberal Party') an unencorporated association constittuting a'person' or 'group of individuals' which has its headquarters in London . The second applicant, Mrs R ., is a British citizen born in 1929resident in Middlesex . England and is by occupation a housewife and Justice of the Peace . The third applicant, Mr P., is also a British citizen, born in 1935, resident in London and by occupalion a stockbroker . They are represented by Mr A . Phillips of the law firm Bates, Wells & Braithwaite, the seat of which is in London .From the statements and documents submitted it appears that the applicants complain that they are affected adversely by the British electoral system, constituting breaches of the Convention . In support of their claim they state that the elected legislature of the Unite d Kingdom is the House of Commons which consists of 635 Members of Parliament elected in accordance with the provisions of the Representation of the People Act 1949 as amended ('the 1949 Act') . Rule 18 of the Parliamentary Election Rules contained in Schedule 2 to the 1949 Act provides as follow s 'The votes at the poll shall be given by ballot . The results shall be ascertained by counting the votes given to each candidate, and the candidates to whom the majority of the votes had been given shall be declared to have been elected .' In practice 'majority' means the 'largest number' of votes cast an d dues not mean 'more than half' of the votes cast. The existing United Kingdom Parliamentary electoral system, referred to as 'the simple majority system', br 'the first-past-the-post system' has existed in its present form since legislation of 1949 which came into force in March and April 1956 .The accepted opinion in the two major pa rties, the Conservative Party and the Labour Party, particularly after 1949, has been that the simple majority system was the best for their party political purposes .It has been clear that a change which would make the electoral system more representative would l...Voir le contenu complet de ce document
