La UE actúa contra doce Estados miembro en materia de transgénicos
El pasado 10 de abril la Comisión Europea requirió formalmente a doce Estados miembro de UE que adopten la normativa necesaria para implementar ladirectivas comunitaria en materia de transgénicos, que deberían haber sido transpuesta antes de octubre de 2002.
Francia, Luxemburgo, Bélgica, Países Bajos, Alemania, Italia, Irlanda, Grecia, España, Portugal, Austria y Finlandia han sido ya advertidos de que la falta de transposición en la legislación nacional de la Directiva 2001/18/CEE sobre la liberación intencional en el medio ambiente de organismos genéticamente modificados comportará el inicio de procedimientos judiciales a instancia de la Comisión contra dichos Estados miembro ante el Tribunal de Justicia de la UE.
En este sentido, el Comisario de Medio Ambiente, Margot Wallström, responsable de los efectos medioambientales de los organismos genéticamente manipulados en el seno de la Comisión ha requerido “a los Estados miembros a homogeneizar rápidamente sus legislaciones nacionales con el nuevo marco acordado por la UE para regular la liberación de organismos genéticamente manipulados en el medio ambiente"”.
La directiva en cuestión revisa el marco regulador original en materia de liberación de organismos genéticamente modificados en la UE, que se estableció en respuesta a las preocupaciones por los posibles daños irreversibles que podrían derivarse de la liberación de dichos organismos podría causar al medio ambiente. A tal efecto, la Directiva introduce principios que regulan la evaluación del riesgo ambiental, la supervisión obligatoria de los transgénicos desde su puesta en el mercado, el procedimiento de autorización y prevé un límite de diez años de vigencia máxima de las autorizaciones iniciales de organismos genéticamente manipulados.
