Quelques développements réglementaires et jurisprudentiels intervenus en droit communautaire depuis le 1er avril 2000, date à laquelle le présent manuscrit a été achevé, méritent d'être signalés, dans la mesure où ils confirment et/ou complètent les initiatives annoncées.
La Commission a présenté le 26 avril 2000 deux initiatives importantes dans le secteur des télécommunications : l'une concerne la mise en place d'un nouveau cadre réglementaire, et l'autre vise l'ouverture de l'accès à la boucle locale pour les nouveaux opérateurs des télécommunications.
a. - La Commission a annoncé l'adoption de cinq directives-cadres portant respectivement sur le cadre de l'infrastructure des télécommunications, les licences et les autorisations, l'accès et l'interconnexion, le service universel et les droits des consommateurs, la protection des données dans le secteur des télécommunications et, enfin, sur les aspects de la concurrence. Les apports principaux de cette future législation résideront dans la simplification des textes (le nombre de règlements passant ainsi de 25 à 6), dans la réduction des procédures administratives et dans l'abandon de tout projet d'une autorité européenne unique de régulations des télécommunications.
La Commission a proposé de réviser également la signification de la notion de part de marché, qui détermine les obligations concrètes des opérateurs historiques qui doivent ouvrir leurs réseaux aux concurrents. Les opérateurs sont actuellement classés selon leur seuil de part de marché, pour déterminer s'ils y occupent une part significative (25 %) ou une « position dominante » (50 %). Le nouveau cadre remplacerait ces seuils par le concept de « dominance » qui se traduira dans une approche plus flexible et un seuil unique. Page 680
b. - Dans le but de favoriser l'entrée de nouveaux arrivants dans un secteur qui reste encore sous le monopole de certains opérateurs historiques bénéficiant de droits exclusifs, la Commission a adopté une communication du 26 avril 2000 (COM(2000)237final), intitulée « Dégroupage de l'accès à la boucle locale : permettre la fourniture concurrentielle d'une gamme complète de services de communications électroniques, notamment les services multimédias à large bande et l'Internet à haut débit », qui a pour but de favoriser l'accès de tous les nouveaux opérateurs à la boucle locale.
Cette communication doit être lue en parallèle avec la recommandation de la Commission rendue publique le 25 mai 2000 dans laquelle elle invite les États membres à concrétiser l'ouverture de la boucle locale d'ici la fin de l'année 2000...
