RESUMEN: El presente trabajo trata de exponer un análisis de la reciente reforma de la Ley 12/2022 en la normativa de los
planes de pensiones en lo referido a la voluntariedad de este instrumento y la libre adhesión a los mismos desde la perspec-
tiva de la libre autonomía de la voluntad contractual, además de la imperatividad de la CE y de su doctrina constitucional,
respecto a que las prestaciones complementarias del sistema de público de pensiones serán libres. Aunque se acuerde un
derecho de previsión mediante acuerdo o convenio instrumentado en planes de pensiones de empleo ha de regir el prin-
cipio de voluntariedad, así como el de irrenunciabilidad de derechos de previsión en el marco de las relaciones laborales.

ABSTRACT: The present paper tries to present an analysis of the recent reform of Law 12/2022 in the regulations of pension
plans in relation to the voluntary nature of this instrument and free adherence to them from the perspective of the free au-
tonomy of the contractual will, in addition to the imperative of the EC and its constitutional doctrine, with respect to the fact
that the complementary benefits of the public pension system will be free. Even if a social security right is agreed upon by
means of an agreement or agreement implemented in employment pension plans, the principle of voluntary action must
govern, as well as the inalienability of social security rights in the framework of labor relations.
