La Convención como alternativa a la conferencia diplomática en la reforma de los tratados

En la Declaración nº 23 relativa al futuro de la Unión, después del Tratado de Niza (26 de febrero de 2001) en su apd. 4, se señala:
"- Tras un informe que se presentará en Gotemburgo, en junio de 2001, el Consejo Europeo aprobará, en su reunión de Laeken/Bruselas en diciembre de 2001, una declaración que incluya iniciativas adecuadas para la continuación de este proceso".
Y, añade en su apd. 5:
"Este proceso deberá abordar, en particular las siguientes cuestiones:
- la forma de establecer y supervisar una delimitación más precisa de las competencias entre la Unión Europea y los Estados miembros, que respete el principio de subsidiariedad;
- el Estatuto de la Carta de los Derechos Fundamentales de la Unión Europea, proclamada en Niza, de conformidad con las conclusiones del Consejo Europeo de Colonia;
- la simplificación de los Tratados con el fin de clarificarlos y facilitar su comprensión, sin cambiar su significado;
- la función de los Parlamentos nacionales en la arquitectura europea".
La Declaración de Laeken sobre el futuro de la Unión Europea (Consejo Europeo, 14 y 15 de diciembre de 2001) en su apd. III regula "LaPage 25 Convocatoria de una Convención sobre el futuro de Europa", y dice expresamente:
"Para garantizar una preparación lo más amplia y transparente posible de la próxima Conferencia Intergubernamental, el Consejo Europeo ha decidido convocar una Convención que reúna a los principales participantes en el debate sobre el futuro de la Unión. A la vista de lo anterior, dicha Convención tendrá el cometido de examinar las cuestiones esenciales que plantea el futuro desarrollo de la Unión a investigar las distintas respuestas posibles".
El Consejo Europeo ha nombrado al Sr. V. Giscard d'Estaing, Presidente de la Convención, y a los Sres. G. Amato y J.L. Dehaene, Vicepresidentes.
Además de su Presidente y de sus dos Vicepresidentes, la Convención constará de 15 representantes de los Jefes de Estado o de Gobierno de los Estados miembros (uno por cada Estado miembro), de 30 miembros de los Parlamentos Nacionales (dos por Estado miembro), de 16 miembros del Parlamento Europeo y de dos representantes de la Comisión. Los países candidatos a la adhesión participarán plenamente en los trabajos de la Convención.
