I. INTRODUCTION: LEX REI SITAE RULE

AS THE APPLICABLE LAW TO REAL ESTATE

1. Rights in rem pertain to tangible assets and impact all parties

involved, while personal rights regarding assets can solely be enforced

against the debtor. 1 Therefore, to safeguard and promote the exchange

of goods in international trade, Private International Law strives to

allocate rights in rem to their holders clearly, determining competent

courts and, specically in this context, the relevant law governing

rights in rem.

2. In Spanish private international law, the law governing «rights in

rem over goods considered as single units is determined in accordance
