RESUMEN

En el presente trabajo se hablará de la posibilidad que tienen las partes del procedimiento

concursal de sustituir el periodo de consultas por un arbitraje cuando se trate de la aplicación

de cualquiera de las vicisitudes o de la extinción de los contratos de trabajo, según lo dispuesto

en el Estatuto de los Trabajadores.

Si bien, como se trata de la aplicación de tales medidas durante el procedimiento

concursal, la normativa reguladora encargada del mismo será la Ley concursal, en cuyo

artículo 64 se centrará nuestro estudio.

ABSTRACT

In this paper we discuss about the possibility of the parties to the bankruptcy proceeding

to send the period of consultations through an arbitration when it comes to the application

of any of the vicissitudes or the termination of employment contracts, as provided in the

Estatuto de los Trabajadores.

Although, it is also the application of stories measured during the bankruptcy

proceeding, the regulatory regulations in charge of it will be the Insolvency Act, in which

article 64 our study will focus.
