CIVIL Y MERCANTIL EN EL MERCADO ÚNICO:
EL CASO DE LA CADENA ALIMENTARIA

RESUMEN
La cadena alimentaria representa uno de los sectores normativos con mayor nivel de
armonización legislativa a nivel comunitario. Este ha sido alcanzado a través de la puesta
en marcha de diversos instrumentos legales de aplicación europea y la sugerencia –
principalmente mediante actos jurídicos atípicos, aunque no en exclusiva– de actuación legal
complementaria a nivel nacional de cada Estado miembro a través tanto de instrumentos de
hard law como de soft law.
El modo en que este nivel de armonización legislativa ha sido alcanzado presenta
características propias y sugerentes que le hacen meritorio de un examen en profundidad, a
fin de evaluar la eventual pertinencia de su extrapolación a otros sectores normativos.

ABSTRACT
Food supply chain represents one of the sectors with the highest level of legislative
harmonization at the Community level. This level has been achieved through the
implementation of various legal instruments with European scope and the suggestion –mainly
through “atypical acts” (or sui generis acts), although not exclusively– of complementary legal
action at national level of each Member State through both hard law and soft law instruments.
The way in which this level of harmonization has been achieved has its own and
suggestive characteristics that make it worthy of an in-depth examination, in order to evaluate
possible relevance of its extrapolation to other normative sectors.
