C’è spazio per una fiscalità degli stili di vita?*

Il termine fiscalité comportamentale non definisce una categoria giuridica
precisa, facendo riferimento a quelle, variegate, forme di interventi tributari
che hanno, anche, la finalità di incidere sugli stili di vita dei singoli: la
fiscalità dell’ambiente, la fiscalità alimentare, la fiscalità cosiddetta “etica”.

come, nel sistema giuridico italiano, l’utilizzo dello strumento tributario per
questi scopi è ammissibile a due condizioni. Per un verso, è necessario che il
tributo colpisca comunque manifestazioni di forza economica (art. 53
Cost.); per l’altro, che ciò non costituisca una violazione del principio di
uguaglianza, anche alla luce di altri principi di rango costituzionale.
Il tributo deve dunque essere giustificato sul piano economico e che si possa
giustificare, alla luce dei valori dell’ordinamento, l’eventuale diversità di
trattamento che in questo modo si determina in relazione a certi soggetti,
attività, atti, prodotti, consumi, ecc.
A mio avviso, sulla base di queste premesse, non dovrebbero essere
ammissibili, perché incostituzionali, forme di tassazione la cui finalità
extrafiscale è esclusivamente di natura etica o morale.
Questo anche perché in un sistema costituzionale “aperto”, di ispirazione
liberale, interventi di questo tipo sono in grado di alterare le scelte
individuali, comprimendo la libertà dei singoli.
Peraltro, se determinate condotte dalla Stato sono considerate pericolose,
se determinati consumi sono considerati inammissibili, in rapporto a valori
