DIRETTIVA 2006/28/CE DELLA COMMISSIONE
del 6 marzo 2006
che modifica, per adeguarle al progresso tecnico, la direttiva 72/245/CEE del Consiglio relativa alla soppressione delle perturbazioni radioelettriche (compatibilità elettromagnetica) dei veicoli e la direttiva 70/156/CEE del Consiglio concernente il ravvicinamento delle legislazioni degli Stati Membri relative all'omologazione dei veicoli a motore e dei loro rimorchi

LA COMMISSIONE DELLE COMUNITÀ EUROPEE,
visto il trattato che istituisce la Comunità europea,
vista la direttiva 70/156/CEE del Consiglio, del 6 febbraio 1970, concernente il ravvicinamento delle legislazioni degli Stati membri relative all'omologazione dei veicoli a motore e dei loro rimorchi (1), in particolare l'articolo 13, paragrafo 2,
vista la direttiva 72/245/CEE del Consiglio, del 20 giugno 1972, relativa alla soppressione delle perturbazioni radioelettriche (compatibilità elettromagnetica) dei veicoli (2), in particolare l'articolo 4,
considerando quanto segue:
(1) | La direttiva 72/245/CEE è una delle direttive particolari a norma della procedura di omologazione stabilita dalla direttiva 70/156/CEE. |
(2) | Per migliorare la sicurezza dei veicoli, sviluppando l'uso di tecnologie basate su apparecchiature radar a corto raggio per autoveicoli, la Commissione ha armonizzato con la decisione 2004/545/CE dell'8 luglio 2004 relativa all'armonizzazione dello spettro radio nella banda di frequenze 79 GHz ai fini dell'uso di apparecchiature radar a corto raggio per autoveicoli nella Comunità (3) e con la decisione 2005/50/CE del 17 gennaio il 2005 relativa all'armonizzazione dello spettro radio nella banda di frequenze 24 GHz ai fini dell'uso limitato nel tempo di apparecchiature radar a corto raggio per autoveicoli nella Comunità, l'uso delle due bande di frequenza dello spettro radio (4). |
(3) | In conformità con la decisione 2005/50/CE, l’utilizzo di apparecchiature radio a corto raggio da 24 GHz è limitata nel tempo e gli Stati membri hanno istituito un sistema di controllo che verifichi il numero di veicoli dotati di apparecchiature radar a corto raggio nella banda 24 GHz immatricolati nel loro territorio. |
(4) | La direttiva 72/245/CEE, modificata dalla direttiva 2005/49/CE della Commissione (5), fornisce agli Stati membri i mezzi adeguati per effettuare tale controllo. La direttiva 70/156/CEE è stata modificata di conseguenza dalla suddetta direttiva. |
(5) | È ora evidente che le modalità per fornire dati relativi alle apparecchiature radar a corto raggio nella banda da 24 GHz possono essere semplificate, di conseguenza non è necessario richiedere dati relativi all’utilizzo delle apparecchiature radar a corto raggio nella banda da 79 GHz per motivi di controllo nel certificato di conformità (CoC) oltre alle informazioni relative alle apparecchiature da 24 GHz, dal momento che la banda da 79 GHz non interferisce con altre applicazioni e il suo uso non è limitato. È necessario quindi modificare i requisiti relativi all’uso dell’apparecchiatura radar a corto raggio da 24 GHz ed eliminare i requisiti relativi all’utilizzo dell’apparecchiatura radar a corto raggio da 79 GHz nella direttiva 72/245/CEE. La presente direttiva non altera la validità dell’omologazione dei veicoli non dotati di un’apparecchiatura radar a corto raggio nella banda da 24 GHz. |
(6) | Solo i servizi tecnici emettono omologazioni secondo il modello di cui all’allegato III C della direttiva 72/245/CEE. Nessun’altra autorità o amministrazione è coinvolta nella procedura. Quindi l’ulteriore timbro dell’attestazione ora richiesto è superfluo e sarà eliminato. |
(7) | La direttiva 72/245/CEE deve pertanto essere modificata di conseguenza. |
(8) | Le modifiche alla direttiva 72/245/CEE si riflettono sulla direttiva 70/156/CEE. È pertanto opportuno |
