El Consejo Europeo de junio de 2006 acordó ampliar hasta la segunda mitad de 2008 el plazo de reflexión para decidir qué hacer con la Constitución europea. El presidente de turno de la Unión, el canciller austriaco Wolfgang Schüssel presentó a los entonces veinticinco, ahora veintisiete, un calendario que, hasta ese momento, prevé seguir presentando iniciativas políticas, confiar a la presidencia alemana en el primer semestre de 2007 el planteamiento de alternativas sobre la Constitución y adoptar una decisión durante el año siguiente, bajo presidencia francesa y tras las elecciones que se celebrarán en el país galo y en Holanda, los dos únicos países que rechazaron el tratado constitucional. Se trataría de resolver en 2008 la cuestión institucional porque el actual tratado de Niza establece un cambio importante en la composición de la Comisión Europea con un número de Estados de la Unión que supera los 27, número que se alcanzó el 1 de enero de 2007 con la incorporación de Rumania y bulgaria; además, en 2009 habrá una nueva Comisión y un nuevo parlamento europeos.
Dieciocho de los veintisiete países de la Unión, dos tercios de la misma, ya dieron su visto bueno a la Constitución europea, mientras que Reino Unido, portugal, Suecia, Dinamarca, República Checa, polonia o irlanda no contemplan la posibilidad de ratificar el texto en próximas fechas.

Entre los que dieron luz verde a la Constitución se encuentran España y Luxemburgo, que lo hicieron mediante sendos referenda, mientras que Francia y Holanda eligieron el mismo método pero optaron por rechazarla. Sin embargo, si computamos el total de españoles, franceses, holandeses y luxemburgueses que acudieron a las urnas para elegir una opción o la contraria, son aquellos que votaron 'sí' quienes ganan con amplia ventaja, casi cuatro millones, a quienes votaron 'no'.
Por el momento, la situación que existe tras el rechazo del texto de Francia y Holanda en referéndum no supone el fin de la Constitución Europea, aunque lo complica, y más bien evidencia que el proceso está más vivo que nunca después de un año en el que parecía que el resultado de las consultas populares había acabado con la Constitución Europea.
