SENTENCIA DEL TRIBUNAL DE JUSTICIA (Sala Cuarta) de 27 de octubre de 2005 en el asunto C-165/05: Comisión de las Comunidades Europeas contra Gran Ducado de Luxemburgo (1 ) ('Incumplimiento de Estado -- Libre circulación de personas -- Trabajadores -- Cónyuges -- Exigencia de un permiso de trabajo al cónyuge nacional de un tercer Estado') (2005/C 330/13) (Lengua de procedimiento: francés) En el asunto C-165/05, que tiene por objeto un recurso por incumplimiento interpuesto, con arreglo al artículo 226 CE, el 8 de abril de 2005, Comisión de las Comunidades Europeas (agente: Sr. G. Rozet) contra Gran Ducado de Luxemburgo (agente: Sr. S. Schreiner), el Tribunal de Justicia (Sala Cuarta), integrado por el Sr. J.N. Cunha Rodrigues (Ponente), en funciones de Presidente de la Sala Cuarta, y los Sres. K. Lenaerts y E. Levits, Jueces; Abogado General: Sra. J. Kokott; Secretario:
Sr. R. Grass, ha dictado el 27 de octubre de 2005 una sentencia cuyo fallo es el siguiente:
1) Declarar que el Gran Ducado de Luxemburgo ha incumplido las obligaciones que le incumben en virtud del artículo 11 del Reglamento (CEE) no 1612/68 del Consejo, de 15 de octubre de 1968, relativo a la libre circulación de los trabajadores dentro de la Comunidad, al imponer su legislación la obtención de un permiso de trabajo para los nacionales de terceros Estados casados con trabajadores migrantes de la Unión Europea y al no haber adaptado su legislación al Derecho comunitario.
2) Condenar en costas al Gran Ducado de Luxemburgo.
