Visto el Tratado constitutivo de la Comunidad Europea y, en particular, su artículo 37 y su artículo 299, apartado 2,
Vista la propuesta de la Comisión,
Visto el dictamen del Parlamento Europeo (1),
Visto el dictamen del Comité Económico y Social Europeo (2),
Considerando lo siguiente:
(1) El sector pesquero en las regiones ultraperiféricas de la Comunidad experimenta dificultades, entre las que destacan los costes adicionales originados por la comercialización de determinados productos pesqueros debido a las dificultades particulares señaladas en el artículo 299, apartado 2, del Tratado y derivados principalmente del coste de transporte a Europa continental.
(2) Para mantener la competitividad de ciertos productos pesqueros en relación con la de productos similares de otras regiones comunitarias, a partir de 1992 la Comunidad introdujo una serie de medidas para compensar los costes adicionales en dicho sector. El Reglamento (CE) no 2328/2003 del Consejo (3) recoge las medidas aplicadas durante el período 2003-2006. Es necesario que a partir de 2007 sigan en vigor las medidas para compensar los costes adicionales de la comercialización de determinados productos pesqueros, sobre la base de un informe de la Comisión al Parlamento Europeo, al Consejo y al Comité Económico y Social Europeo.
(3) Habida cuenta de las diferentes condiciones de comercialización en las regiones ultraperiféricas en cuestión, las fluctuaciones de capturas y existencias y de demandas del mercado, debe dejarse a los Estados miembros correspondientes que determinen los productos pesqueros con derecho a la compensación, sus cantidades máximas respectivas y los importes de la compensación dentro de la asignación global por Estado miembro.
(4) Debe autorizarse a los Estados miembros a diferenciar para cada una de las regiones que les pertenezca la lista de productos pesqueros y las cantidades así como el importe de compensación dentro de la asignación global por Estado miembro. También debe autorizárseles a modular sus planes de compensación si las condiciones cambiantes así lo justifican.
(5) Los Estados miembros deben fijar el importe de compensación en un nivel que permita una compensación adecuada de los costes adicionales, derivados de las dificultades específicas de las regiones ultraperiféricas y, en especial, de los costes de transporte de los productos a Europa continental. Para evitar la sobrecompensación, el importe debe ser proporcional a los costes adicionales y en ningún caso exceder del 100 % de los costes de transporte y otros costes conexos a Europa continental.
Con este fin, también deben tenerse en cuenta otros tipos de intervención pública que repercuten en el nivel de los costes adicionales.
