DIRECTIVA 2006/91/CE DEL CONSEJO
de 7 de noviembre de 2006
relativa a la lucha contra el piojo de San José
(Versión codificada)
EL CONSEJO DE LA UNIÓN EUROPEA,
Visto el Tratado constitutivo de la Comunidad Europea y, en particular, sus artículos 37 y 94,
Vista la propuesta de la Comisión,
Visto el dictamen del Parlamento Europeo (1),
Visto el dictamen del Comité Económico y Social Europeo (2),
Considerando lo siguiente:
(1) | La Directiva 69/466/CEE del Consejo, de 8 de diciembre de 1969, relativa a la lucha contra el piojo de San José (3), ha sido modificada (4) de forma sustancial. Conviene, en aras de una mayor racionalidad y claridad, proceder a la codificación de dicha Directiva. |
(2) | La producción de plantas dicotiledóneas leñosas y sus frutos tiene gran importancia en la agricultura de la Comunidad. |
(3) | Los organismos nocivos comprometen constantemente el rendimiento de dicha producción. |
(4) | La protección de dichas plantas frente a dichos organismos nocivos no solo debe mantener su capacidad de producción, sino constituir además un medio para incrementar la productividad de la agricultura. |
(5) | Las medidas de protección contra la introducción de organismos nocivos en cada Estado miembro solo tendrían un alcance limitado, si al mismo tiempo no se combatieran dichos organismos metódicamente en el conjunto de la Comunidad y se evitara su propagación. |
(6) | Uno de los organismos nocivos más peligrosos para las plantas dicotiledóneas leñosas es el piojo de San José (Quadraspidiotus perniciosus Comst.). |
(7) | Dicho organismo nocivo ha aparecido en varios Estados miembros y existen zonas contaminadas en la Comunidad. |
(8) | Existe un peligro permanente para los cultivos en toda la Comunidad, si no se adoptan medidas eficaces para combatir dicho organismo nocivo e impedir su propagación. |
(9) | A fin de erradicar dicho organismo nocivo, conviene adoptar disposiciones mínimas para la Comunidad. Los Estados miembros deben poder adoptar disposiciones complementarias o más rigurosas, en la medida en que estas últimas sean necesarias. |
(10) | La presente Directiva no debe afectar a las obligaciones de los Estados miembros relativas a los plazos de transposición al Derecho nacional de las Directivas que figuran en el anexo I, parte B. |
HA ADOPTADO LA PRESENTE DIRECTIVA:
Artículo 1
La presente Directiva se refiere a las medidas mínimas que deberán adoptarse en los Estados miembros para combatir el piojo de San José (Quadraspidiotus perniciosus Comst.) y evitar su propagación.
Artículo 2
A los efectos de la presente Directiva, se entenderá por:
a) | «vegetales»: las plantas vivas y las partes vivas de plantas, excepto los frutos y semillas; |
b) | «vegetales o frutos contaminados»: los vegetales o frutos en los que se encuentren uno o varios piojos de San José, cuando no esté demostrado que estén muertos; |
c) | «plantas portadoras del piojo de San José»: los vegetales de los géneros Acer L., Cotoneaster Ehrh., Crataegus L., Cydonia Mill., Evonymus L., Fagus L., Juglans L., Ligustrum L., Malus Mill., Populus L., Prunus L., Pyrus L., Ribes L., Rosa L., Salix L., Sorbus L., Syringa L., Tilia L., Ulmus L., Vitis L.; |
d) | «viveros»: los cultivos en los que se produzcan vegetales destinados a la replantación, a la multiplicación o a la puesta en circulación como plantas individuales con raíz. |
Artículo 3
Al comprobar la aparición del piojo de San José, los Estados miembros delimitarán la zona contaminada y una zona de seguridad lo bastante amplia para garantizar la protección de las zonas colindantes.
Artículo 4
Los Estados miembros establecerán que, en las zonas contaminadas y en las de seguridad, deberá efectuarse un tratamiento adecuado de las plantas portadoras del piojo de San José para combatir dicho organismo nocivo y evitar su propagación.
Artículo 5
Los Estados miembros establecerán que:
a) | se destruyan todos los vegetales contaminados que se encuentren en viveros; |
b) | todos los demás vegetales contaminados, o que se sospeche que puedan estarlo, y que crezcan en una zona |
