DIRETTIVA DEL CONSIGLIO del 12 ottobre 1971 per il ravvicinamento delle legislazioni degli Stati membri relative ai dispositivi accessori per contatori di liquidi diversi dall'acqua (71/348/CEE)
IL CONSIGLIO DELLE COMUNITÀ EUROPEE,
viste le disposizioni del trattato che istituisce la Comunità economica europea, in particolare l'articolo 100,
vista la proposta della Commissione,
visto il parere del Parlamento europeo (1),
visto il parere del Comitato economico e sociale (2),
considerando che negli Stati membri la costruzione e le modalità di controllo dei dispositivi accessori per contatori di liquidi formano oggetto di disposizioni imperative che differiscono da uno Stato membro all'altro, ostacolando così gli scambi di detti dispositivi ; che occorre pertanto procedere al ravvicinamento di tali disposizioni;
considerando che la direttiva del Consiglio del 26 luglio 1971 per il ravvicinamento delle legislazioni degli Stati membri relative agli strumenti di misura ed ai metodi di controllo metrologico (3) ha definito le procedure di approvazione CEE del modello e di verifica prima CEE ; che, conformemente a tale direttiva, occorre fissare per i dispositivi accessori per contatori di liquidi diversi dall'acqua le prescrizioni tecniche di realizzazione e di funzionamento;
considerando che la direttiva del Consiglio del 26 luglio 1971 per il ravvicinamento delle legislazioni degli Stati membri relative ai contatori di liquidi diversi dall'acqua (4) ha già fissato le prescrizioni tecniche alle quali detti contatori devono essere conformi ; che i dispositivi accessori possono o devono far parte integrante di determinati contatori di liquidi diversi dall'acqua,
HA ADOTTATO LA PRESENTE DIRETTIVA:
Articolo 1
La presente direttiva si applica ai dispositivi accessori per contatori volumetrici di liquidi diversi dall'acqua definiti nell'allegato.
Articolo 2
I dispositivi accessori per contatori volumetrici che possono ricevere i marchi e i contrassegni CEE sono descritti nell'allegato. Essi formano oggetto di un'approvazione CEE del modello. Essi sono sottoposti alla verifica prima CEE contemporaneamente ai contatori ai quali sono associati.
Articolo 3
1. Gli Stati membri mettono in vigore le disposizioni legislative, regolamentari e amministrative necessarie per conformarsi alla presente direttiva entro un termine di diciotto mesi a decorrere dalla notifica e ne informano immediatamente la Commissione.
2. Gli Stati membri provvedono a comunicare alla Commissione i testi delle disposizioni essenziali di diritto interno che essi adottano nel settore disciplinato dalla presente direttiva.
Articolo 4
La presente direttiva è destinata agli Stati membri.
