DIRETTIVA DEL CONSIGLIO
del 20 marzo 1978
relativa ai rifiuti tossici e nocivi
( 78/319/CEE )
IL CONSIGLIO DELLE COMUNITA EUROPEE ,
visto il trattato che istituisce la Comunità economica europea , in particolare gli articoli 100 e 235 ,
vista la proposta della Commissione ,
visto il parere del Parlamento europeo ( 1 ) ,
visto il parere del Comitato economico e sociale ( 2 ) ,
considerando che una disparità tra le disposizioni in applicazione o in preparazione nei vari Stati membri per lo smaltimento dei rifiuti tossici e nocivi puo creare disuguaglianza nelle condizioni di concorrenza e avere percio un ' incidenza diretta sul funzionamento del mercato comune ; che è quindi necessario procedere , in questo settore , al ravvicinamento delle legislazioni previsto dall ' articolo 100 del trattato ;
considerando che appare necessario che tale ravvicinamento delle legislazioni sia accompagnato da un ' azione della Comunità per raggiungere con una più ampia regolamentazione uno degli obiettivi della Comunità nel settore della protezione dell ' ambiente e del miglioramento della qualità della vita ; che , a tal fine , occorre quindi prevedere alcune disposizioni specifiche ; che , non essendo stati previsti dal trattato i poteri d ' azione necessari a tal fine , occorre fare ricorso all ' articolo 235 del trattato ;
considerando che i programmi d ' azione delle Comunità europee in materia ambientale del 1973 ( 3 ) e del 1977 ( 4 ) sottolineano la necessità di azioni comunitarie , al fine di controllare l ' eliminazione dei rifiuti tossici e nocivi ;
considerando che ogni regolamento in materia di smaltimento dei rifiuti tossici e nocivi deve essenzialmente mirare alla protezione della salute umana e dell ' ambiente contro gli effetti dannosi della raccolta dei rifiuti tossici e nocivi , nonché del loro trasporto , trattamento , ammasso e deposito ;
considerando l ' importanza di favorire la prevenzione , il riutilizzo e il recupero dei rifiuti tossici e nocivi e l ' utilizzazione dei materiali di ricupero per preservare le risorse naturali ;
considerando che , per assicurare una protezione efficace dell ' ambiente , occorre prevedere un sistema uniforme di autorizzazioni per le imprese che provvedono all ' ammasso , al trattamento e / o al deposito dei rifiuti tossici e nocivi ; che occorre che i detentori di rifiuti tossici e nocivi _ privi di autorizzazione _ li facciano ammassare e / o trattare solo dalle imprese autorizzate ;
considerando che la parte dei costi di smaltimento dei rifiuti tossici e nocivi non coperta dalla valorizzazione dei rifiuti deve essere ripartita secondo il principio " chi inquina paga " ;
considerando che occorre prevedere un sistema di controllo e di sorveglianza degli impianti , degli stabilimenti o delle imprese che producono , detengono o smaltiscono i rifiuti tossici e nocivi , tenere aggiornati i dati relativi alle operazioni di smaltimento , assicurare che ogni trasporto di rifiuti tossici e nocivi effettuato nel corso di operazioni di smaltimento sia accompagnato da un formulario di identificazione ed elaborare programmi che tengano conto delle operazioni collegate allo smaltimento dei rifiuti ;
considerando che , al fine di coordinare l ' azione in questo settore , gli Stati membri devono redigere una relazione sullo smaltimento dei rifiuti tossici e nocivi ;
considerando che il progresso tecnico rende necessario un rapido adeguamento dell ' elenco dei rifiuti tossici e nocivi ai quali si applica la presente direttiva ; che , per facilitare l ' attuazione dei provvedimenti all ' uopo necessari , è opportuno prevedere una procedura che instauri una stretta cooperazione tra gli Stati membri e la Commissione nell ' ambito di un comitato per l ' adeguamento della presente direttiva al progresso tecnico ,
