DIRECTIVE 97/42/CE DU CONSEIL du 27 juin 1997 portant première modification de la directive 90/394/CEE concernant la protection des travailleurs contre les risques liés à l'exposition à des agents cancérigènes au travail (sixième directive particulière au sens de l'article 16 paragraphe 1 de la directive 89/391/CEE)

LE CONSEIL DE L'UNION EUROPÉENNE,

vu le traité instituant la Communauté européenne, et notamment son article 118 A,

vu la directive 90/394/CEE du Conseil, du 28 juin 1990, concernant la protection des travailleurs contre les risques liés à l'exposition à des agents cancérigènes au travail (sixième directive particulière au sens de l'article 16 paragraphe 1 de la directive 89/391/CEE) (1), et notamment son article 16,

vu la proposition de la Commission (2), établie après consultation du comité consultatif pour la sécurité, l'hygiène et la protection de la santé sur le lieu de travail,

vu l'avis du Comité économique et social (3),

statuant conformément à la procédure visée à l'article 189 C du traité (4),

(1) considérant que l'article 118 A du traité prévoit que le Conseil arrête, par voie de directive, les prescriptions minimales en vue de promouvoir l'amélioration, notamment du milieu de travail, pour garantir un meilleur niveau de protection de la sécurité et de la santé des travailleurs;

(2) considérant que, selon ledit article, ces directives doivent éviter d'imposer des contraintes administratives, financières ou juridiques telles qu'elles contrarieraient la création et le développement de petites et moyennes entreprises;

(3) considérant que la directive 91/325/CEE de la Commission, du 1er mars 1991, portant douzième adaptation au progrès technique de la directive 67/548/CEE du Conseil concernant le rapprochement des dispositions législatives, réglementaires et administratives relatives à la classification, à l'emballage et à l'étiquetage des substances dangereuses (5) introduit dans son annexe III de nouvelles phrases de risque indiquant les dangers pour la...
