Germany has been condemned by the European Court of Justice for the red tape it imposes on companies based in other EU member states which want to post their non-EU national workers to Germany. On January 19, the ECJ said (Case C-244/04) Berlin was wrong to force such third-country nationals to get a visa before being posted to Germany. The Court also ticked off Germany for making the granting of the visa conditional on the worker having been employed for at least a year by the posting company.
