(1) La Unión se ha fijado como una de sus finalidades fomentar la protección de los derechos del niño, tal como se recoge en el artículo 3 del Tratado de la Unión Europea. Una parte esencial de esta política está constituida por medidas para la protección de los menores contra su traslado o retención ilícitos.
(2) El Consejo adoptó el Reglamento (CE) n.o 2201/2003(2) (en lo sucesivo, «Reglamento Bruselas II bis»), que tiene por objeto proteger a los niños contra los efectos perjudiciales de su traslado o retención ilícitos y establecer procedimientos que aseguren su restitución inmediata a su Estado de residencia habitual, así como garantizar la protección de los derechos de visita y de custodia.
(3) El Reglamento Bruselas II bis complementa y refuerza el Convenio de La Haya de 25 de octubre de 1980 sobre los aspectos civiles de la sustracción...
