DIRECTIVE DU CONSEIL du 12 octobre 1971 concernant le rapprochement des législations des États membres relatives au mesurage de la masse à l'hectolitre des céréales (71/347/CEE)
LE CONSEIL DES COMMUNAUTÉS EUROPÉENNES,
vu le traité instituant la Communauté économique européenne, et notamment son article 100,
vu la proposition de la Commission,
vu l'avis de l'Assemblée (1),
vu l'avis du Comité économique et social (2),
considérant que les instruments et méthodes utilisés dans les États membres pour le mesurage de la masse à l'hectolitre des céréales sont disparates et ont une incidence directe sur le fonctionnement du marché commun ; qu'un rapprochement des législations en ce domaine doit faciliter les échanges non seulement des céréales, mais aussi des instruments de mesurage;
considérant que, à cette fin il convient de définir une caractéristique spéciale, dénommée «masse à l'hectolitre CEE» et de fixer les prescriptions techniques auxquelles doivent satisfaire les instruments étalons à l'aide desquels est établie cette valeur de référence;
considérant que des instruments de mesurage qui ont une précision définie par rapport à celle des instruments étalons et qui ont fait l'objet des contrôles prévus dans la directive du Conseil, du 26 juillet 1971, concernant le rapprochement des législations des États membres relatives aux dispositions communes aux instruments de mesurage et aux méthodes de contrôle métrologique (3) donnent des garanties suffisantes pour qu'ils soient d'utilisation légale dans tous les États membres ; qu'en conséquence ils deviennent commercialisables dans toute la Communauté;
considérant qu'il est nécessaire d'interdire dans le commerce entre États membres le mesurage de la masse à l'hectolitre des céréales selon les dispositions ou les usages divers actuellement appliqués dans la Communauté ; que l'utilisation exclusive et obligatoire d'une masse à l'hectolitre CEE, commune à tous les États membres, préviendra effectivement toute contestation dans les échanges intracommunautaires sur ce mode de mesurage,
A ARRÊTÉ LA PRÉSENTE DIRECTIVE:
Article premier
La présente directive concerne: a) la définition de la caractéristique des céréales, dénommée masse à l'hectolitre CEE (EEG-natuurgewicht, EWG-Schüttdichte, peso ettolitrico CEE),
b) les prescriptions de réalisation technique et d'utilisation de l'instrument étalon de référence qui intervient dans la définition de la masse à l'hectolitre CEE,

Article 2
1. La masse à l'hectolitre CEE est le rapport de la masse, exprimée en kilogrammes, au volume, exprimé en hectolitre, tel qu'il est obtenu pour une céréale quelconque, en effectuant le mesurage avec un instrument et selon une méthode conformes à la présente directive.
2. Est dite «de référence» la masse à l'hectolitre CEE obtenue en effectuant le mesurage avec un instrument étalon, communautaire ou national, construit et employé conformément aux chapitres I et II de l'annexe I.
3. La masse à l'hectolitre CEE de référence s'exprime en kilogrammes par hectolitre avec deux décimales.
