UN MODELO CORPORATIVISTA EN CUESTIÓN

RESUMEN
Como es sabido, los actores que intervienen en el diseño de las políticas sociales a nivel
comunitario son múltiples, pues se conjuga el reconocimiento de la autonomía privada de
los agentes sociales con el protagonismo de las instituciones europeas. A este respecto, debe
ponerse de manifiesto el carácter corporativista de este modo de hacer política, pues son los
propios interesados los que tienen reconocida la capacidad legislativa para adoptar las normas
que les vincularán. Así, estos agentes sociales no disfrutan de la legitimidad democrática de
origen, por cuanto no son elegidos en elecciones, sino que su fuente de legitimidad descansa
(o, mejor dicho, debería descansar) sobre la representatividad que tienen respecto de los
interesados.
Por ello, y teniendo presente que en el ámbito de políticas sociales pueden convertirse
en colegisladores, la representatividad de cada organización y el mandato democrático
negociador debiera ser una cuestión nítidamente resuelta a nivel comunitario. En contraste,
ninguna norma europea establece previsión alguna para poder identificar a aquellos que
están llamados a llevar a cabo esta labor, poniendo en entre dicho la legitimidad democrática
del proceso negociador, así como de los productos normativos con alcance europeo que
de la Unión Europea se refieren expresamente a la negociación colectiva comunitaria
entre “los interlocutores sociales”, pero sin identificarlos ni señalar criterios mínimos de
representatividad para ello.
