REGLAMENTO (CE) No 1186/2008 DE LA COMISIÓN de 28 de noviembre de 2008 por el que se fijan los derechos de importación aplicables en el sector de los cereales a partir del 1 de diciembre de 2008
LA COMISIÓN DE LAS COMUNIDADES EUROPEAS,
Visto el Tratado constitutivo de la Comunidad Europea,
Visto el Reglamento (CE) no 1234/2007 del Consejo, de 22 de octubre de 2007, por el que se crea una organización común de mercados agrícolas y se establecen disposiciones específicas para determinados productos agrícolas (Reglamento único para las OCM) (1),
Visto el Reglamento (CE) no 1249/96 de la Comisión, de 28 de junio de 1996, por el que se establecen disposiciones de apli cación del Reglamento (CEE) no 1766/92 del Consejo en lo que concierne a los derechos de importación en el sector de los cereales (2), y, en particular, su artículo 2, apartado 1,
Considerando lo siguiente:
(1) El artículo 136, apartado 1, del Reglamento (CE) no 1234/2007 dispone que el derecho de importación de los productos de los códigos NC 1001 10 00, 1001 90 91, ex 1001 90 99 (trigo blando de calidad alta), 1002, ex 1005, excepto los híbridos para siembra, y ex 1007, excepto los híbridos para siembra, es igual al precio de intervención válido para la importación de tales productos, incrementado un 55 % y deducido el precio cif de importación aplicable a la remesa de que se trate.
No obstante, ese derecho no puede sobrepasar los tipos de los derechos de importación del arancel aduanero común.
(2) El artículo 136, apartado 2, del Reglamento (CE) no 1234/2007 establece que, a efectos del cálculo del dere cho de importación a que se refiere el apartado 1 de ese mismo artículo, deben establecerse periódicamente pre cios de importación cif representativos de los productos considerados.
(3) Según lo dispuesto en el artículo 2, apartado 2, del Reglamento (CE) no 1249/96, el precio que debe utili zarse para calcular el derecho de importación de los productos de los códigos NC 1001 10 00, 1001 90 91, ex 1001 90 99 (trigo blando de calidad alta), 1002 00, 1005 10 90, 1005 90 00 y 1007 00 90 es el precio re presentativo de importación cif diario, determinado con arreglo al método previsto en el...
