La evolución de la formación de la vida familiar ha experimentado un cambio notable en las últimas décadas en el seno de las sociedades democráticas euro-peas. La familia ha pasado de ser creada fundamentalmente a través del vínculo matrimonial a nacer también de diferentes tipos de uniones extramatrimoniales, uniones de hecho de personas de diferentes sexos o de un mismo sexo o simplemente de personas solteras que al tener un hijo crean una vida familiar. Por lo tanto, en la actualidad la vida familiar engloba no sólo la creada por el matrimonio sino también la que se crea por la convivencia en uniones de hecho o por el nacimiento o adopción de un hijo (familias monoparentales). Ya no cabe distinguir entre familias «legítimas», «naturales» o «adulterinas»: todas son constitutivas por igual de vida familiar. En consecuencia, se establece el principio de igualdad en la filiación y el principio de protección de las relaciones factuales que establecen una vida familiar.
El principio de igualdad en la filiación no implica un trato idéntico entre las familias formadas diferentemente, sino que conlleva, esencialmente, que no puede existir ningún tipo de discriminación directa o indirecta entre las familias que se base en el nexo de unión que las forman. Consiguientemente, no puede existir ninguna discriminación respecto al nacimiento en base a la filiación.

Este principio de igualdad en la filiación supone que en ningún caso se debe distinguir entre hijos legítimos, naturales o adulterinos, es decir de familias de doble vínculo y que todas los tipos de familias deben gozar de los mismos derechos642.
En lo que se refiere a la filiación materna natural, el principio mater semper certa est se reconoce de forma general. Al contrario, la filiación paterna natural puede ser limitada en algunos casos y será relevante la posición del padre respecto a su descendencia. Es decir, los padres que establezcan una relación estable y estrecha con sus hijos podrán reclamar la paternidad y los derechos que de ella se derivan, sin que prevalga una automaticidad en la filiación paterna natural643, eso sí, sin ningún tipo de discriminación y teniendo siempre en cuenta el interés superior del menor644.
