The Council of Ministers' draft framework decision aiming to require the generalised conservation of telecommunications traffic data for at least twelve months, for possible use by law enforcement agencies, has drawn serious reservations from other European institutions and industry. Criticism is directed at both the substance and detail of the initiative. A hearing staged on May 3 by the European Parliament permitted stock to be taken of this hostility.

The European Commission feels the initiative is based on a poor legal basis. Its experts maintain that in view of the obligations imposed on the industry, it should be based on a "first pillar" (internal market) instrument - through, for example, a directive.
