OF THE HOST ON TOURIST ACCOMMODATION

RESUMEN: En la presente Comunicación, se pretende abordar el deber de información al consumidor, a cargo del pro-
veedor de un mercado en línea, referido a la necesaria identif‌icación del carácter de comerciante o no del tercero
que ofrece los bienes o servicios en ese mercado digital. Dicha cuestión adquiere particular relevancia ya que de ella
depende, en buena manera, la aplicación o no de la normativa nacional y comunitaria de protección al consumidor.
En particular, se analizará dicha problemática en el contexto de las plataformas digitales de alojamiento turístico, en
las que no siempre el huésped o consumidor adquiere plena consciencia de la condición de empresario o no de su
anf‌itrión, con las consiguientes diferencias que ello puede implicar en punto a una adecuada y razonable protección
de sus derechos e intereses.

al consumidor.
ABSTRACT: The purpose of this Communication is to address the consumer information duty of the provider of an online mar-
ketplace to identify whether or not the third party offering the goods or services on that digital marketplace has the status
of a merchant. This issue is of particular relevance since the application or non-application of national and Community
consumer protection legislation depends to a large extent on it. In particular, this issue will be analysed in the context of
digital tourist accommodation platforms, where the guest or consumer is not always fully aware of the host’s status as a
merchant or not, with the consequent differences that this may imply in terms of adequate and reasonable protection of
their rights and interests.
