III. Cómo reivindicar y ejercer sus derechos

Si considera que las administraciones nacionales, regionales o locales han interpretado o aplicado mal sus derechos, o han cometido una discriminación contra usted o algún miembro de su familia, no está usted indefenso. Ante todo, ¡no dude en reivindicar sus derechos! A escala nacional, puede dirigirse a la administración competente. Si ésta persiste en no atender a sus demandas, tiene usted aún otras posibilidades a su disposición.
Le conviene acudir, en primer lugar, a las instancias nacionales, ya que dispondrá de más vías de recurso y podrá, en su caso, obtener una indemnización. Además, los jueces nacionales deben garantizar el respeto del Derecho comunitario e invalidar, en caso necesario, la aplicación de cualquier disposición o medida contraria al mismo.
Pero hay también otras posibilidades a escala comunitaria.
Por ejemplo, puede usted enviar una queja a la Comisión Europea (véase Direcciones útiles). Si se comprueba que su queja está justificada, la Comisión podrá ponerse en contacto con la administración nacional responsable para pedir explicaciones y exigir que cese la infracción del Derecho comunitario. De no obtener satisfacción, la Comisión podrá iniciar un procedimiento contra el país en cuestión, el cual puede desembocar en un recurso ante el Tribunal de Justicia de las Comunidades Europeas.
También tiene usted derecho a presentar una petición al Parlamento Europeo (véase Direcciones útiles) o comunicar su problema a un eurodiputado de su elección, el cual podrá formular las correspondientes preguntas a la Comisión y al Consejo de Ministros. Las respuestas de estas instituciones se harán públicas.
Por último, puede dirigirse al Defensor del Pueblo Europeo (véase Direcciones útiles), pero únicamente si su queja se refiere a un caso de mala administración de las instituciones comunitarias (como el Parlamento, el Consejo o la Comisión) o de un organismo descentralizado de las Comunidades (como, por ejemplo, la Fundación Europea de Formación). Por "mala administración" se entiende generalmente una insuficiencia o un defecto de administración como son las irregularidades y las omisiones administrativas. Sin embargo, esta definición no abarca todos los casos posibles.
N.B.: el Defensor del Pueblo Europeo no tiene competencias para ocuparse de las quejas que se refieren a las actividades de las administraciones nacionales o locales.
