INTELLECTUAL PROPERTY: CONSULTATION OPENED ON UPDATING EU COPYRIGHT LEGISLATION.

The consultation is based on a Working Paper* that mainly focuses on Directives adopted between 1991 and 1996:

- Software Directive (91/250/EC - legal protection for computer programmes)

- the Rental Right Directive (92/100/EEC)

- the Term of Protection Directive (93/98/EEC: harmonising protection of copyright and related rights)

- the Database Directive (96/9/EC: legal protection for databases)

Directive 93/83/EEC on the co-ordination of certain rules concerning copyright in satellite broadcasting and cable retransmission is subject to a separate review process, which began in 2002.

Among those aspects deserving special attention, the Commission notes that the definition of "reproduction right" has gradually evolved in the legislation and therefore varies from one Directive to another. Amendments to align the terminology used in the different Directives could prove useful. In a similar vein, the Commission sees a chance to introduce a new exception in the aforementioned Directives, taking into account temporary acts of reproduction.
