Rules setting out an authorisation process for people wanting to open new shops in Poland are one of the European Commission's targets in its latest round of infringement proceeding decisions, a number of which relate to the internal market.

The Polish case involves a law of 11 May 2007 which requires 'an authorisation for the establishment of new retail facilities'. Among the Commission's concerns is that the law seeks to ensure 'the maintenance of a balance between various forms of retailing' without explaining how this criteria should apply in practice. It is also concerned that existing shop owners in the area can play a role helping authorities decide whether authorisation should be granted. The Polish authorities have been sent a letter of formal notice by the Commission.
