Abstract

inmore detailproperty relationsbetween spousesin marriageand aerthe dissolutionof

marriage.

Spousesmay requestthe divisionof propertyduring marriageand aerits dissolutionIn

practicethedivision ofpropertyprimarilytakesplaceaerthedissolutionofmarriageand

muchlessduringitsexistenceThemainfactorsthatpromptthespousestorequestthedivision

ofpropertyaerthedissolutionofthemarriagearedisputesbetweenthemandinsuchcases

Divisionofjointpropertycanbedonebyagreementduringtheexistenceofmarriage

butinpracticethesecasesareveryrareThemostcommoncasesofjointproperty

divisionofspousesarethosethroughlitigationduetodisagreementsbetweenthem

Thispartisequallydividedandeachonereceiveshishershareasentitledbasedon

thecontributionduring theexistence of marriageand jointworkThe assessment

of the contribution of spouses is based on several criteria, such as: personal income

and other income of the spouses, child care and education, property maintenance,

managingofhouseworkandother formsof workregarding themaintenanceand

increaseofjointpropertyThepersonalincomecriterionismainlyexpressedwiththe

employedspousesandthosewhohaveothersourcesofincome

Other criteria related to childcare and housework apply mainly in cases where

spousesareunemployedorhousewives
