Legal and social aspects of acts on domestic violence

Abstract

The purpose of this study is to identify the malfunctional relationship between family

members, resulting in domestic violence. This violence includes a wide range of acts such

as physical, emotional, nancial and one of the most recent one with various of cases, sexual

abuse. It not only harms the victim which of course suers the most ,but it also shows great

danger for the other family members ,making them a indirect victim .Domestic violence is

dened as a group of behaviours that aim at controlling others through the use of force ,

intimidation and manipulation. Comparing it with other forms of crime, it is not done all of a

sudden or accidentally, on the contrary in many cases involves physical injuries, emotional and

psychological concussion done in a long period of time, continually. This work forwards aspects

regarding sociology, law and family. Training in and specialized responses to children and

women exposed to domestic violence have gradually been developed by various community

and government agencies, resulting in new policies, interagency protocols, and legislation. In

addition, the successes and failures of these laws and protocols in other jurisdictions can be

an invaluable resource in the eort to evaluate the appropriateness of adopting a particular

policy or law and to anticipate any unintended negative eects the law or policy may have

on victims of domestic violence.The eradication of this phenomenon is a task not only of the

justice system but it is also necessary to involve civil society to a have a very active role.

This study aempts to identify and classify acts of violence, it‘s causes and consequences, as

well as possible solutions to minimize cases of violence between family members.

Introduction

Domestic violence is a worldwide phenomenon, which aects negatively on physical,

psychological, economic and social integrity, especially of the most vulnerable part

of society: women and children. Violence is dened from dierent sociologists as an

act performed by one or many people, through which comes ill treatment, injury,

manipulation, suering and other like so, which aect the integrity and morality of

one or more people. Domestic violence and abuse are used for one purpose and one

purpose only: to gain and maintain total control over you.While on legal framework

there are some specic denitions:1

• “Violence” – every action or inaction of one person on another, which follows in

aecting his physical moral, economic and social integrity.

• “Domestic Violence”- every act of violence performed between family members

aecting ones physical, social, moral integrity.

• “Family members” -will be considered the spouse, ex-spouse, cohabitant, brothers

or sisters of the spouse if they have been living together the 3 last months, childrens
