RESUMEN

El presente trabajo aborda algunas cuestiones en relación con el Título II de la Propuesta

de Directiva europea sobre reestructuración y segunda oportunidad, relativo a los marcos

de reestructuración preventiva. Tras analizar los aspectos generales de la Propuesta, se

estudia separadamente la posibilidad de establecer una moratoria, el acuerdo o plan de

reestructuración -donde se analiza asimismo las diferentes tipos de acuerdos que prevé

la Propuesta y sus presupuestos esenciales-, y la protección que se le otorga a la nueva

financiación. En último lugar, se realizan unas consideraciones en relación con la adaptación a

los ordenamientos jurídicos europeos una vez se apruebe la Directiva.

ABSTRACT

This paper analyzes some issues related to Title II of the Proposal for a European Directive

on restructuring and second chance, regarding preventive restructuring frameworks. In this

regard, and after analyzing the general aspects of the Proposal, we analyze the possibility of

establishing a moratorium, the restructuring plan -where the different types of agreements

foreseen in the Proposal and its essential budgets are also analyzed-, and the protection

granted to the new financing. Finally, some considerations are made regarding the adaptation

to the European legal systems once the Directive is approved.
