(2004/C 11 E/044) PREGUNTA ESCRITA E-3250/02 de Margrietus van den Berg (PSE) a la Comisión (19 de noviembre de 2002) Asunto: Propuesta de la Comisión sobre el acceso a los medicamentos para los países en desarrollo En el comunicado de prensa de 30 de octubre de la Comisión titulado 'La Comisión da luz verde al plan destinado a fomentar el acceso de los países en desarrollo a los medicamentos', en el que se anuncia un reglamento del Consejo para prevenir la importación encubierta en la UE de determinados productos farmacéuticos esenciales, se afirma que resulta claro que en la práctica los países pobres no necesitarán recurrir a licencias obligatorias si obtienen los medicamentos que necesitan en el marco de una tarificación diferenciada.
Lo anterior representaría una grave evolución. El instrumento de la tarificación diferenciada implica una serie de importantes inconvenientes entre los que se incluye principalmente el hecho de que se basa finalmente en medidas voluntarias de la industria farmacéutica.
¿Puede suponerse que la Comisión no va a proponer el instrumento de la tarificación diferenciada como sustituto de los instrumentos defendidos con grandes dificultades en la Declaración relativa al Acuerdo sobre los ADPIC y la salud pública, en el marco del Acuerdo sobre los ADPIC, que pueden abaratar los medicamentos? Respuesta del Sr. Lamy en nombre de la Comisión (17 de diciembre de 2002) Resulta poco probable que un país que pueda acceder a medicamentos a precios asequibles expida una licencia obligatoria. Al hacerlo, el propietario de la patente retiraría sus productos de los mercados, ya que el propietario de los derechos no va a competir con sus propios productos. Este caso se da en mercados tanto de países desarrollados como de países en desarrollo.
