HACIA UN ESPACIO DE VALORES

RESUMEN

Este trabajo aborda el complejo proceso de construcción de la Unión Europea desde uno

de sus puntos álgidos como fue la creación y puesta en marcha del mercado único europeo.

Adoptando una metodología de Derecho constitucional, se pretende realizar un análisis del

elemento territorial de la Unión, de acuerdo con las posiciones de Jellinek. Cuestiones como el

Brexit o aspiraciones secesionistas en algunos Estados, además de las futuras ampliaciones en

negociación, inciden directamente sobre el territorio de la Unión, y por ende, sobre el ámbito

de aplicación de sus normas. En este sentido, la creación del mercado único fue un revulsivo

en la conformación real de un espacio unitario, que nos servirá como arranque de una mayor

unión. Desde esta óptica, y siguiendo posiciones haeberlianas, pretenderemos dar una visión

de la Unión que supera la sola perspectiva económica para transcender a una Europa de

valores y cultura como clave para entender la evolución y proyección de la Unión.

ABSTRACT

This paper addresses the complex process of construction of the European Union from one

of its high points as was the creation and implementation of the European market. Adopting a

constitutional law methodology, an analysis of the territorial element of the Union is planned, in

accordance with Jellinek’s positions. Issues such as the Brexit or secessionist aspirations in some

States, in addition to future enlargements in negotiation, have a direct impact on the territory of

the Union, and therefore on the scope of application of its norms. In this sense, the creation of the

market was a revulsive in the real conformation of a unitary space, which will serve as the starting

point of a greater union. From this perspective, and following Haeberlian positions, we intend to

give a vision of the Union that surpasses the only economic perspective to transcend a Europe of

values and culture as key to understanding the evolution and projection of the Union.
