Teniendo en cuenta la expresa voluntad constituyente de limar cualquier obstáculo que impidiera la adhesión a la Europa unida y la preva-Page 58lencia de la doctrina monista al establecer el procedimiento de adaptación del Derecho internacional al Derecho interno, vemos que necesariamente se ven facilitadas las relaciones de integración que deben darse entre el Derecho de la Unión Europea y el Derecho español. Dada la existencia de "sectores aconstitucionales" que el artículo 93 de la CE permite, se posibilita, entre otras, la cesión de una competencia estatal que en esencia se considera soberana: la función legislativa. No viene al caso analizar con detalle los distintos instrumentos normativos que configuran el Derecho originario y derivado de las antiguas Comunidades Europeas, ni las consecuencias que la integración de dicho Derecho en el Derecho interno pueda producir, así como la relevancia de los principios acuñados por la jurisprudencia del Tribunal de Luxemburgo, en especial los principios de primacía recogido actualmente en el Proyecto de Tratado Constitucional en el art. I-6, y el principio de efecto directo (RODRÍGUEZ IGLESIAS, 1993).
Por primacía del derecho de la Unión Europea, principio consagrado por el Tribunal de Luxemburgo en la Sentencia de 15 de junio de 1964 (asunto Costa/ENEL) se entiende la superioridad del derecho Comunitario sobre el Derecho interno, basada en los caracteres y en los objetivos de la Unión Europea actual a la que los Estados miembros han transferido determinadas competencias que llevan consigo la consiguiente limitación de la competencia estatal. Por eficacia directa de las normas comunitarias el Tribunal de Justicia de la Unión ha reiterado que se entiende que tales normas "crean derechos individuales que las jurisdicciones nacionales deben salvaguardar" es decir, que producen efectos jurídicos plenos, tanto en relación con los Estados como en relación con los particulares, sin necesidad de que entre ellos y sus destinatarios se interponga otro poder normativo. Pero, a la hora de afrontar las transformaciones acaecidas en el sistema interno de fuentes por la cesión de potestades normativas hay que tener en cuenta que entre éstas se encuentra la posibilidad de obligar internacionalmente a un Estado, además de la potestad normativa directa e indirecta.
