Il moltiplicarsi di una pluralità di organizzazioni internazionali regionali, in particolare dalla fine dello scorso secolo, costituisce un dato di fatto, evidentemente rilevante nel mondo del diritto internazionale. Il fenomeno, caratterizzato da differente densità normativa, si è esteso alle più diverse aree geografiche, anche a quelle tradizionalmente indifferenti al fenomeno associativo, sì che solo per il mondo araboislamico si rileva, significativamente, l’esistenza di una regione senza regionalismo. Molte esperienze associative regionali (non tutte) hanno provveduto, nel trattato istitutivo ovvero con un atto successivo, all’instaurazione di una Corte di giustizia o di un meccanismo arbitrale istituzionalizzato per la soluzione delle controversie sorte nell’ambito dell’organizzazione.
Nel medesimo arco temporale, abbiamo assistito ed assistiamo al diffondersi di una pluralità di istanze giurisdizionali internazionali, collegate o relative ad istanze tendenzialmente universali, parziali o regionali.
Ben al di là della mera coincidenza temporale, i due fenomeni sono destinati a sviluppare un processo di multifertilizzazione incrociata. A tale riguardo non si può fare a meno di osservare preliminarmente che l’esperienza della Corte di giustizia europea pur non assunta come modello, sicuramente costituisce un importante punto di riferimento per le altre Corti, in particolare per quelle sorte in America latina, nei Caraibi e nel continente africano. Dai più recenti sviluppi risulta che i nuovi apparati giurisdizionali/arbitrali risultano pienamente operativi: le Corti sono state materialmente costituite e jurisdicono, emanando le prime sentenze o lodi arbitrali e, talora, i primi pareri consultivi.
Peraltro, se il fenomeno della moltiplicazione delle istanze giurisdizionali nelle sue diverse articolazioni, soprattutto universali, è stato oggetto di un amplissimo dibattito in dottrina, minore interesse sembra manifestarsi per gli apparati giurisdizionali istituiti nell’ambito del...
