Cualquier persona física o jurídica que se considere afectada por una decisión de la EIOPA puede recurrir contra ella e igualmente lo pueden hacer los supervisores de seguros de los Estados miembros. Un poco a semejanza de nuestros recursos administrativos, se puede presentar un recurso previo contra la decisión que nos afecte, como en nuestro recurso de reposición o se puede ir directamente al Tribunal de Justicia. Veamos ambos supuestos.
Este recurso, que el Reglamento denomina de "apelación" en su Considerando (58), aunque yo creo que se trata de un recurso previo, se debe presentar por escrito ante el propio Supervisor Europeo que haya tomado la decisión recurrida, en el plazo máximo de dos meses a partir de la fecha de notificación al interesado de dicha decisión o de su publicación en el DOUE y debe contener una exposición de los motivos por los que se recurre (art. 60 del Reglamento). Aunque el Reglamento no dice nada al respecto, de su tramitación se deduce que una vez recibido el escrito, el Supervisor Europeo lo debe trasladar a la Sala de Recurso, la cual examinará si lo considera fundado y lo admite o no, invitando en el primer caso a las partes a presentar sus observaciones sobre sus propias alegaciones en el caso del recurrente y a los recurridos sobre las de las otras partes, pudiéndose hacer estas alegaciones oralmente. Este recurso no tiene por regla general efectos suspensivos, aunque si el recurrente lo solicitara, la Sala de Recurso así lo podría acordar si lo considerara conveniente, en cuyo caso la aplicación de la decisión recurrida quedaría en suspenso.
Tras su tramitación, la Sala de Recurso podrá desestimar el recurso presentado con la consiguiente confirmación de la validez de la decisión recurrida o estimarlo, en cuyo caso remitirá el asunto al departamento del Supervisor Europeo que la hubiera tomado para que la modifique en el sentido de la sentencia. Estas sentencias o "resoluciones" (como las denomina el Reglamento) de la Sala de Recurso, han de ser razonadas, se harán públicas y se tomarán en un plazo máximo de dos meses a contar de la fecha de interposición del recurso.
