REGLAMENTO (CE) N o 307/2008 DE LA COMISIÓN
de 2 de abril de 2008
por el que se establecen, de conformidad con el Reglamento (CE) no 842/2006 del Parlamento Europeo y del Consejo, los requisitos mínimos de los programas de formación y las condiciones de reconocimiento mutuo de los certificados de formación del personal en lo que respecta a los sistemas de aire acondicionado de ciertos vehículos de motor que contengan determinados gases fluorados de efecto invernadero

LA COMISIÓN DE LAS COMUNIDADES EUROPEAS,
Visto el Tratado constitutivo de la Comunidad Europea,
Visto el Reglamento (CE) no 842/2006 del Parlamento Europeo y del Consejo, de 17 de mayo de 2006, sobre determinados gases fluorados de efecto invernadero (1), y, en particular, su artículo 5, apartado 1,
Considerando lo siguiente:
(1) | La Directiva 2006/40/CE del Parlamento Europeo y del Consejo, de 17 de mayo de 2006, relativa a las emisiones procedentes de sistemas de aire acondicionado en vehículos de motor y por la que se modifica la Directiva 70/156/CEE del Consejo (2), obliga a que, a partir de 2011, los sistemas de aire acondicionado instalados en vehículos de motor tengan un potencial reducido de calentamiento atmosférico. Como medida a corto plazo, el Reglamento (CE) no 842/2006 exige el establecimiento de normas relativas a la adecuada cualificación del personal encargado de la recuperación de los gases fluorados de efecto invernadero de tales sistemas. |
(2) | Resulta oportuno permitir, durante un período de tiempo limitado, al personal matriculado en un curso de formación a los efectos de obtención de un certificado realizar actividades integradas en el curso de formación y para las que se exija dicho certificado, siempre que esté bajo la supervisión de personal que posea tal certificado. |
(3) | Para que el personal empleado actualmente en los sectores contemplados en el presente Reglamento pueda recibir una formación y certificación sin tener que interrumpir su actividad profesional, es necesario un período de transición adecuado durante el cual el personal que se haya formado con arreglo a los programas de cualificación existentes o cuente con experiencia profesional pueda considerarse debidamente cualificado a los efectos del Reglamento (CE) no 842/2006. |
(4) | A fin de evitar una carga administrativa excesiva, conviene autorizar el reconocimiento de los programas de cualificación existentes, siempre que las aptitudes y los conocimientos a que se refieran y el sistema de cualificación pertinente sean equivalentes a las normas mínimas previstas en el presente Reglamento. |
(5) | El cumplimiento de los requisitos mínimos establecidos en el presente Reglamento debe garantizarse a través de organismos de certificación designados oficialmente, que contribuyan así a un reconocimiento mutuo efectivo y eficaz de los certificados de formación en toda la Comunidad. |
(6) | Resulta oportuno comunicar a la Comisión información sobre los sistemas de certificación que den lugar a la expedición de certificados sujetos a reconocimiento mutuo en la forma prevista por el Reglamento (CE) no 308/2008 de la Comisión, de 2 de abril de 2008, por el que se establece, de conformidad con el Reglamento (CE) no 842/2006 del Parlamento Europeo y del Consejo, el modelo para la notificación de los programas de formación y certificación de los Estados miembros (3). Es conveniente informar a la Comisión sobre el reconocimiento, durante un período transitorio, de los sistemas de cualificación existentes o la experiencia profesional. |
(7) | Las medidas previstas en el presente Reglamento se ajustan al dictamen del Comité creado por el artículo 18, apartado 1, del Reglamento (CE) no 2037/2000 del Parlamento Europeo y del Consejo (4). |
