Si durante siglos el orden nacional regula en libertad, sin apenas constricciones externas, la casi totalidad de las cuestiones de orden interno tales como la igualdad, libertad y justicia de los habitantes del Estado, a partir de la II guerra mundial, con la creación de Naciones Unidas, y más precisamente con el final de la guerra fría, el Derecho internacional contiene mayores exigencias en materia de Derecho Constitucional o público. En particular, aquél se ha ocupado de regular problemáticas como la de las obstrucciones a la manifestación de la identidad, o prohibición y obstáculo al uso de la lengua materna, o en sentido más amplio, la de cómo acomodar la diversidad lingüística dentro de los límites del Estado, por su importancia para el orden, la democracia y los derechos humanos120. La soberanía estatal queda así constreñida a operar nece-

sariamente dentro de esos límites hablándose de «porosidad de la soberanía estatal», o declive del papel del Estado121, y de tendencia a la imbricación de los ordenes jurídicos. A partir de la segunda mitad del siglo XX se deja a un lado la lógica de la homogeneidad en la configuración de los Estados-nación, y la correspondiente negación del otro, sobre la que se fue forjando la tradición política occidental, para dar paso en la Comunidad internacional al respeto de la diversidad lingüística. Este respeto durante bastate tiempo será entendido en los términos que representa el modelo america-no, que propone «separar la pertenencia al Estado de la identidad cultural: separar pues la arquitectura política,…, de la arquitectura cultural, diferenciar entre fronteras políticas y fronteras culturales». Hacer al Estado «laico en lo cultural», sin una cultura propia.122. Y que conduce a que la diversidad idiomática encuentre protección en la garantía de la no discriminación y la libertad de expresión, la libertad de expresar la propia lengua. A partir de los años 90, empero, gana terreno en el Derecho positivo internacional un nuevo entendimiento del respeto de la diversidad idiomática consistente en que los Estados asuman el compromiso de procurar condiciones para que las realidades lingüísticas se manifiesten y convivan pacíficamente123. Ya dijimos al comienzo de esta parte de nuestro estudio que el TC español en la capital STC 82/86, de 26 de junio, apreciaba sobre la base del Preámbulo constitucional y de los arts. 3 y 20, que la Norma suprema había reconocido la diversidad...
