En su ponencia inicial, el Prof. GRASSO hizo especial hincapié en la importancia de la entrada en vigor de la Constitución Europea para que los derechos fundamentales reconocidos en la Carta de Niza del año 2000 -y en la actualidad recogidos en la Parte II del Tratado constitucional europeo- adquieran fuerza vinculante. En su opinión dicho texto constitucional abría nuevas posibilidades para que los derechos fundamentales desplieguen una considerable influencia sobre el Derecho penal tanto de la Unión Europea como de los Estados Miembros. En este sentido, consideró que el Derecho penal europeo contenido en el Espacio de Libertad, Seguridad y Justicia constituye un terreno privilegiado para la aplicación de los derechos fundamentales; más aún, expuso que ciertas políticas de la Unión dependen claramente de los derechos fundamentales, y a este respecto resaltó cómo la creación del Espacio antes mencionado - que se basa en una «confianza recíproca» - sólo se puede alcanzar en la medida en la que exista un cierto estándar de tutela de derechos fundamentales que quede asegurado y consolidado. GRASSO fue de la opinión de que una de las ventajas más notables del texto constitucional europeo es que el acervo de derechos fundamentales existente se puede aumentar por vía del artículo I-9 §3. Así, sobre la base de dicho precepto se pueden incluir derechos fundamentales que sean comunes a las tradiciones constitucionales de los Estados Miembros. Refiriéndose al caso específicamente jurídico-penal, de esta manera se podría subsanar la ausencia de mención expresa del principio de culpabilidad que se puede apreciar en la Constitución Europea.
En su intervención, Jacobo LÓPEZ BARJA recordó los ingentes esfuerzos que se habían realizado a lo largo de los años para llegar a la situación actual que se vive en Europa. Sin embargo, llamó la atención sobre un fenómeno reciente que puede advertirse en la jurisprudencia del Tribunal Europeo de Derechos Humanos (TEDH): la progresiva disminución del «listón» de los derechos fundamentales europeos con motivo de la entrada en la Unión Europea de ciertos países cuyos cánones constitucionales no se corresponden realmente con el estándar europeo.
