In Case C-314/03: Commission of the European Communities (Agent: G. Rozet), with an address for service in Luxembourg, against Grand Duchy of Luxembourg (Agent: S. Schreiner): Application for a declaration that, by failing to adopt and, in any event, by failing to communicate to the Commission the laws, regulations and administrative provisions necessary to comply with Directive 2000/52/EC of 26 July 2000 amending Directive 80/723/EEC on the transparency of financial relations between Member States and public undertakings (OJ 2000 L 193, p. 75), the Grand Duchy of Luxembourg has failed to fulfil its obligations under that directive, the Court (Fifth Chamber), composed of: C. Gulmann, President of the Chamber, S. von Bahr (Rapporteur) and R. Silva de Lapuerta, Judges; A. Tizzano, Advocate General; R. Grass, Registrar, has given a judgment on 9 March 2004, in which it:

Declares that, by failing to adopt the laws, regulations and administrative provisions necessary to comply with Commission Directive 2000/52/EC of 26 July 2000 amending Directive 80/723/EEC on the transparency of financial relations between Member States and public undertakings, the Grand Duchy of Luxembourg has failed to fulfil its obligations under that directive; |

Orders the Grand Duchy of Luxembourg to pay the costs. |
