TELECOMS: POLISH DECISION ON PTC EXPECTED ON DECEMBER 21.

On December 21, a Polish court will issue its ruling in the case of the shareholding structure of Polish mobile phone operator PTC, according to a statement by a spokesperson from Deutsche Telekom on December 6. The case has been the object of a legal fight lasting several years between Deutsche Telekom, Vivendi Universal and Elektrim. The German incumbent owns 49% of PTC and wishes to increase its holdings in order to integrate the Polish operator within its T-Mobile brand, which is already represented in many countries of Eastern and Central Europe.

The litigation concerns the remaining shares of PTC. A Viennese court determined in December 2004 that the Polish group Elektrim, the original owner of 48% of PTC[acute accent]s capital, did not have the right to sell part of its shares to the French company Vivendi Universal and cancelled this transaction.
