Abstract
TheconceptofselfdeterminationisaveryoldconceptrevealedduringtheFren
RevolutionForthersttimeinacademiclevelitwastreatedyearsagofromJ
SMillAccording to him selfdetermination might be understood astherightof
a group of people for separation from a state. For Mill the important thing is the
condition to realize and demand the exercising of the right for selfdetermination as
afreewillexpressedfrompeoplerepresentedfromacommonfeelingofnationthe
wayitisexpressedisnotsoimportantAsignicantconceptrelatedtothisprincipal
isfoundintheDeclarationofIndependenceofUSAapprovedinJulywhich
treatstheseprincipleasastatepowerthatproceedsfromthereconciliation of the
powersthroughwhich He exercises the power conformtowhatpeoplehave the
righttodecideontheirownforthewayofgoverningfortheirsocialstatus
Inthisstatementisstated not just the right to ange or oblige having a wayof
governingwhenitisnotabletoassurelifefreedomandjoybuttheprincipleisalso
treatedasarighttostoppolitical relationsthat establishedwith othernationsand
tooccupyamongthepowersofthisworldthespecialandequalplacethatnatural
lawsandtheirnaturalgodgives
Theright for selfdetermination inthisstatement is mainlytreatedas a right tobe
exercisedinrelationwiththegovernmentandtherightofpeople
In this framework this article claims to historically analyze but also describe the
mostimportantactsinthehistoryofjurisprudenceoftheInternationalRightwhere
theideaandthe principleofselfdeterminationistreatedTheFrenStatementfor
Human Rights and the Statement of Rights for People of Russia, the Statement on
givingindependence to colonizedcountries and nationsthe International Pactfor
CivilPoliticalRightsandtheInternational Pact for the Economic, Social and Cultural
Rights, the Atlantic Card and the principle of self determination.
