DIRECTIVA 2003/110/CE DEL CONSEJO de 25 de noviembre de 2003 sobre la asistencia en casos de tránsito a efectos de repatriación o alejamiento por vía aérea EL CONSEJO DE LA UNIÓN EUROPEA,
Visto el Tratado constitutivo de la Comunidad Europea, yen particular la letra b) del punto 3 del artículo 63,
Vista la iniciativa de la República Federal de Alemania,
Visto el dictamen del Parlamento Europeo,
Considerando lo siguiente:
(1) La asistencia mutua en materia de repatriación o alejamiento obedece al objetivo común de poner fin a la estancia ilegal de nacionales de terceros países que deban abandonar el territorio. Además, la existencia de una normativa vinculante para todos los Estados miembros contribuye a la seguridad jurídica y a la armonización de los procedimientos.
(2) Para poner fin a la estancia de nacionales de terceros países adquiere cada vez mayor importancia la repatriación o alejamiento por vía aérea. A pesar de los esfuerzos de los Estados miembros porutilizar preferentemente enlaces aéreos directos, puede ser necesario,
debido a diversos aspectos económicos o a una oferta insuficiente de vuelos directos, recurrir a enlaces aéreos que hagan escala en aeropuertos de tránsito de otros Estados miembros.
(3) La Recomendación del Consejo, de 22 de diciembre de 1995, relativa a la concertación y cooperación en la ejecución de las medidas de expulsión (1), y la Decisión del Comité ejecutivo de 21 de abril de 1998 relativa a la cooperación entre las Partes contratantes en materia de expulsión de nacionales de terceros países por vía aérea [SCH/Com-ex (98)10] (2), ya trataron la necesidad de cooperación entre Estados miembros en el ámbito de la repatriación o alejamiento por vía aérea de nacionales de terceros países.
(4) La soberanía de los Estados miembros, en particular por lo que respecta al empleo de medidas coercitivas inmediatas contra nacionales de países terceros que se resistan a la repatriación o alejamiento, no debe quedar afectada.
(5) El Convenio de 14 de septiembre de 1963 sobre infracciones y ciertos otros actos cometidos a bordo de aeronaves (Convenio de Tokio), en particular en lo que se refiere a la autoridad a bordo del piloto responsable y a las cuestiones de responsabilidad, no debe quedar afectado.
(6) Por lo que respecta a la información a las compañías aéreas acerca de la realización de repatriaciones o alejamientos con escolta o sin ella, se hace referencia al anexo 9 del Convenio sobre Aviación Civil Internacional (Convenio OACI) de 7 de diciembre de 1944.
(7) Los Estados miembros aplicarán la presente Directiva dentro del respeto de los derechos humanos y de las libertades fundamentales, en particular la Convención de Ginebra sobre el Estatuto de los Refugiados, de 28 de julio de 1951, en la versión modificada del Protocolo de Nueva York de 31 de enero de 1967, y el Convenio Europeo para la Protección de los Derechos Humanos y de las Libertades Fundamentales. Con arreglo a las obligaciones internacionales aplicables, nunca se solicitará ni se concederá el tránsito por vía aérea si en el tercer país de destino o de tránsito el nacional de un tercer país se enfrenta a tratos inhumanos o degradantes, tortura o pena de muerte, o su vida o su libertad se ven amenazadas por motivos de raza, religión, nacionalidad, pertenencia a un grupo social determinado u opiniones políticas.
(8) Las medidas necesarias para la ejecución de la presente Directiva deben aprobarse con arreglo a la Decisión 1999/468/CE del Consejo, de 28 de junio de 1999, por la que se establecen los procedimientos para el ejercicio de las competencias de ejecución atribuidas a la Comisión (3).
(9) De conformidad con los artículos 1 y 2 del Protocolo sobre la posición de Dinamarca anejo al Tratado de la Unión Europea y al Tratado constitutivo de la Comunidad Europea, Dinamarca no participa en la adopción de la presente Directiva, que no la vinculará ni le será aplicable.
