gli affari esteri e la politica di sicurezza), il carattere obbligatorio della Carta dei diritti fondamentali e l’opting out di Regno Unito, Polonia e Repubblica Ceca, la clausola di adesione dell’Unione alla Convenzione europea dei diritti dell’uomo, l’espressa previsione e distinzione delle competenze esclusive, concorrenti e di sostegno, coordinamento o completamento dell’azione degli Stati membri, la possibilità di una revisione dei Trattati tesa a ridurre le competenze dell’Unione nonostante la possibile presenza in quel determinato settore di un acquis comunitario.
Ci sembrano particolarmente interessanti le considerazioni di Ugo Villani in ordine alla vexata quaestio del deficit democratico nell’Unione e del suo eventuale superamento attraverso le novità introdotte dal Trattato di Lisbona: l’autore sostiene, del tutto condivisibilmente, che nonostante il notevole passo avanti costituito dall’aumento dei poteri del Parlamento europeo mediante l’applicazione quasi generale del procedimento di codecisione, un deficit democratico continua a sussistere nell’ordinamento dell’Unione soprattutto per la presenza del Consiglio europeo – ora inserito all’interno del quadro istituzionale dell’Unione (art. 13 TUE) – rispetto al quale “non può tacersi (...) che esso ha determinato una erosione dei poteri di tutte le istituzioni europee, ad esso, in fatto, politicamente subordinate” ossia Consiglio e Commissione (p. 139) nonché per la previsione dell’adozione di regolamenti da parte della BCE senza alcun intervento del Parlamento europeo (p. 181) e per l’assenza di un potere di iniziativa del Parlamento europeo o dei singoli deputati nell’adozione di atti dell’Unione (p. 127).
Inoltre, nella trattazione relativa ai rapporti tra Corte di giustizia e Corte costituzionale italiana, meritano di essere segnalate le prese di posizione – opportunamente riportate da Ugo Villani – di quest’ultima in ordine...
