Finalmente, la Comisión recuerda que el artículo 203 del Tratado CE declara que el Consejo consistirá en un representante de cada Estado miembro a nivel ministerial, autorizado a comprometer al Gobierno de ese Estado miembro. Bajo esta condición, corresponde a cada Estado miembro decidir su representación en las reuniones del Consejo, lo que difiere de un Estado miembro a otro y en lo cual la Comunidad no puede intervenir.

(2002/C 172 E/143) PREGUNTA ESCRITA E-0078/02 de Ulrich Stockmann (PSE) a la Comisión (25 de enero de 2002) Asunto: Posible cierre de la fábrica de vagones de Ammendorf (Halle, República Federal de Alemania) El 12 de noviembre de 2001, el grupo de empresas de construcción de ferrocarriles canadiense Bombardier anunció el cierre de la fábrica de vagones de Ammendorf (Halle, Estado federado de SajoniaAnhalt); ello significa una amenaza de pérdida del empleo para casi 1000 personas.
Antecedentes: tras la reunificación, la Oficina Federal para la solución de los problemas originados por la reunificación (BvS, Bundesanstalt für vereinigungsbedingte Sonderaufgaben), sucesora del organismo fiduciario de saneamiento Treuhand, vendió, tras varios intentos fallidos de privatización, la empresa Deutsche Waggonbau AG, a la que pertenece la planta de Ammendorf, a una empresa de inversiones estadounidense. Ésta, a su vez, vendió Deutsche Waggonbau AG dos años más tarde al grupo industrial canadiense Bombardier.
¿Autorizó la Comisión ayudas estatales para la planta de Ammendorf? En caso afirmativo, ¿por qué cuantía? ¿Recibió la planta de Ammendorf apoyo financiero con cargo a programas comunitarios? En caso afirmativo, ¿de qué cuantía? En caso de que se cierre dicha planta, ¿deben restituirse las ayudas que se hayan autorizado?
