DIRECTIVA 2004/1/CE DE LA COMISIÓN de 6 de enero de 2004 por la que se modifica la Directiva 2002/72/CE en lo relativo a la suspensión de la utilización de la azodicarbonamida como agente expansor (Texto pertinente a efectos del EEE) LA COMISIÓN DE LAS COMUNIDADES EUROPEAS,
Visto el Tratado constitutivo de la Comunidad Europea,
Vista la Directiva 89/109/CEE del Consejo, de 21 de diciembre de 1988, relativa a la aproximación de las legislaciones de los Estados miembros sobre los materiales y objetos destinados a entrar en contacto con productos alimenticios (1) y, en particular, su artículo 3,
Considerando lo siguiente:
(1) La Directiva 2002/72/CE de la Comisión, de 6 de agosto de 2002, relativa a los materiales y objetos plásticos destinados a entrar en contacto con productos alimenticios (2) autoriza la utilización de azodicarbonamida como agente expansor de materiales y objetos plásticos destinados a entrar en contacto con productos alimenticios, de conformidad con el dictamen del Comité científico de la alimentación humana.
(2) La azodicarbonamida se utiliza como agente expansor en la fabricación de juntas de plástico destinadas a las tapas metálicas de frascos de vidrio. Existen nuevos estudios que han puesto de manifiesto que la azodicarbonamida se descompone en semicarbacida (SEM) por acción del calor durante la fabricación de la junta inflada y durante la esterilización del frasco de vidrio sellado.
(3) El 8 de julio de 2003, la industria comunicó a la Autoridad Europea de Seguridad Alimentaria (AESA) que se había encontrado SEM en diversos alimentos envasados en recipientes de vidrio. La concentración de SEM en estos alimentos era variable (hasta 25 µg/kg), encontrándose la más elevada en alimentos para bebés.
(4) Sobre la base científica existente, incluidas las recientes investigaciones encargadas por la AESA, la Comisión técnica de aditivos alimentarios, aromatizantes, auxiliares tecnológicos y materiales en contacto con los alimentos (Comisión ACF), en su informe de 1 de octubre de 2003, llegó a la conclusión de que la SEM presenta una ligera actividad carcinógena en animales de laboratorio y cierta genotoxicidad in vitro, pero que el estado actual del conocimiento...
