l’autre partie à la procédure devant la chambre de recours de l’OHMI, intervenant devant le Tribunal étant,
Quick restaurants SA, établie à Bruxelles (Belgique), représentée par M es É. De Gryse, F. de Visscher et D. Moreau, avocats,
ayant pour objet un recours en annulation contre la décision de la deuxième chambre de recours de l’OHMI du 17 décembre 2003 (affaire R 922/2001-2), relative à une procédure d’opposition entre la Société des Produits Nestlé SA et Quick restaurants SA.
1 Par lettre déposée au greffe du Tribunal le 7 octobre 2009, la partie requérante a informé le Tribunal, conformément à l’article 99 du règlement de procédure du Tribunal, qu’elle se désistait de son recours et que la question des dépens avait fait l’objet d’un accord intervenu entre les parties, aux termes duquel les parties requérante et intervenante supporteront à parts égales les dépens.
2 Par lettre déposée au greffe du Tribunal le 19 octobre 2009, la partie défenderesse a fait savoir au Tribunal qu’elle n’avait pas d’observations à formuler à l’égard du désistement et a demandé que la partie requérante soit condamnée aux dépens en vertu de l’article 87, paragraphe 5, du règlement de procédure.
3 Par lettre déposée au greffe du Tribunal le 22 octobre 2009, la partie intervenante a fait savoir au Tribunal qu’elle marquait son accord sur le désistement de la partie requérante et que, conformément à l’accord intervenu entre les parties requérante et intervenante, les dépens seront partagés par celles-ci à parts égales.
