Decision NumberT-92/20

Recours introduit le 14 février 2020 - Fryč/Commission

(Affaire T-92/20)

Langue de procédure : le tchèque

Parties

Partie requérante : Petr Fryč (Pardubice, République tchèque) (représentant : Š. Oharková, avocate)

Partie défenderesse : Commission européenne

Conclusions

Le requérant conclut à ce qu’il plaise au Tribunal :

décider que les institutions de l’Union ont gravement manqué à leurs obligations et lui ont causé un dommage, car

la Commission a adopté le règlement (CE) no 800/2008 du 6 août 2008 (règlement général d’exemption par catégorie) sous une forme qui va, entre autres, au-delà de l’habilitation législative découlant des traités, qui n’assure pas le respect des principes constitutionnels concernant le caractère exceptionnel et la motivation des atteintes à la concurrence affectant le marché commun, et qui a illégalement permis la mise en œuvre de l’aide d’État dans le cadre d’un programme d’aide (Programme opérationnel Entreprise et innovation, ci-après le « POEI ») qui a nui à l’activité de l’entreprise du requérant ;

par sa décision du 3 décembre 2007, la Commission a adopté le programme opérationnel non conforme aux traités et à la charte des droits fondamentaux de l’Union européenne, et n’a pas publié ladite décision ;

la Commission n’a pas dûment traité les plaintes du requérant contestant la légalité du POEI, car d’une part elle n’a pas vérifié les circonstances de la création et de la réalisation du POEI, et d’autre part elle n’a pas dûment motivé son rejet de la plainte du requérant ;

la Cour de justice de l’Union européenne a refusé d’examiner l’affaire au fond dans le cadre du recours en annulation formé contre le règlement général d’exemption par catégorie et a rejeté le recours comme étant manifestement non fondé, violant ainsi son obligation constitutionnelle d’appliquer le principe de proportionnalité, et, en agissant de manière exagérément formaliste, elle a violé le droit constitutionnel du requérant à un recours effectif et à accéder à un tribunal impartial ;

décider que la défenderesse est tenue de verser au requérant la somme de 4 800 000 EUR en réparation du dommage causé susmentionné, et ce dans les trois jours à compter du jour où l’arrêt devient définitif ;

condamner la défenderesse aux dépens.

Moyens et principaux arguments

À l’appui du recours, le requérant invoque cinq moyens.

Premier moyen tiré de l’existence d’un préjudice au titre de la responsabilité non contractuelle de l’Union en...
