REGLAMENTO (CE) No 332/2009 DE LA COMISIÓN de 23 de abril de 2009 por el que se modifica el anexo I del Reglamento (CEE) no 2658/87 del Consejo relativo a la nomenclatura arancelaria y estadística y al arancel aduanero común LA COMISIÓN DE LAS COMUNIDADES EUROPEAS,
Visto el Tratado constitutivo de la Comunidad Europea,
Visto el Reglamento (CEE) no 2658/87 del Consejo, de 23 de julio de 1987, relativo a la nomenclatura arancelaria y estadística y al arancel aduanero común (1), y, en particular, su artículo 9, apartado 1, letra a),
Considerando lo siguiente:
(1) Para la clasificación de algunos productos de la partida 1905 de la nomenclatura combinada adjunta al Reglamento (CEE) no 2658/87, es preciso hacer una distinción entre, por un lado, los productos de la subpartida 1905 90 20 y, por el otro, las preparaciones clasificadas en la subpartida 1905 90 90.
(2) De acuerdo con las notas explicativas del sistema armonizado de la partida 1905, apartado B, esta partida cubre una serie de productos a base de masa de harina o de fécula, por lo general cocidos y presentados en forma de discos u hojas.
(3) No se ha establecido ninguna definición del término 'productos similares' que figura en la subpartida 1905 90 20.
(4) Tampoco se han definido unos criterios claros para distinguir entre los productos de las subpartidas 1905 90 20 y 1905 90 90, y esto ha ocasionado problemas para la clasificación de las llamadas 'hojas de pasta'.
(5) Procede, por tanto, añadir al capítulo 19 una nota complementaria que establezca que la subpartida 1905 90 20 cubre únicamente productos secos y quebradizos.
(6) Es preciso a tal efecto modificar el Reglamento (CEE) no 2658/87.
