Recurso interpuesto el 1 de marzo de 2004 contra la Comisión de las Comunidades Europeas por Åsa Sundholm (Asunto T-86/04) (2004/C 94/163) (Lengua de procedimiento: francés) En el Tribunal de Primera Instancia de las Comunidades Europeas se ha presentado el 1 de marzo de 2004 un recurso contra la Comisión de las Comunidades Europeas, formulado por Åsa Sundholm, con domicilio en Bruselas, representada por Mes Sébastien Orlandi, Albert Coolen, Jean-Noël Louis y Etienne Marchal, abogados, que designa domicilio en Luxemburgo.
La demandante solicita al Tribunal de Primera Instancia que:
-- Anule la decisión de 10 de abril de 2003 por la que se establece el informe de evolución de la carrera de la demandante para el período comprendido entre el 1 de julio de 2001 y el 31 de diciembre de 2002.
-- Condene en costas a la parte demandada.
Motivos y principales alegaciones En apoyo de su recurso, la demandante alega que el informe impugnado hace referencia a sus ausencias justificadas así como a su estado de salud, infringiendo así el artículo 7, apartado 2, de las disposiciones generales de aplicación del artículo 43 del Estatuto. Asimismo, invoca un error manifiesto de apreciación basado en la supuesta incoherencia entre los comentarios y las calificaciones que se le atribuyen en dicho informe. Por último, la demandante alega que el informe en cuestión no está suficientemente motivado, sobre todo si se tiene en cuenta que no sigue las recomendaciones de la Comisión paritaria de evaluación y que, de conformidad con el artículo 8, apartado 7, de las disposiciones generales de aplicación del artículo 43 del Estatuto, debe incluir una motivación pertinente.
